Ineos Recalls SUVs after Doors Fly Open While Driving – Inneos Lemon Law Lawyers
Ineos Automotive Ltd. Issued a recall affected over 7,000 vehicles in the U.S. after customers reported that the doors on their SUVs flung open while driving. The company is expected to replace door-button mechanisms on all affected Grenadier sport utility vehicles manufactured before April 19, 2024; this is based on reports filed with the U.S. National Highway Traffic Safety Administration.
According to the company, the parts were assembled without enough grease application. This resulted in external buttons on the vehicles sticking, causing the doors to open while the vehicles were being driven. Reportedly, the company has stated that they will pay for all repair costs.
Can I File a Lemon Law Claim?
If your Ineos SUV has a problem that cannot be repaired even after multiple repair attempts have been made, you could have grounds to file a lemon law claim. In California, this right to pursue a claim is based on the Song-Beverly Consumer Warranty Act (or simply the Song-Beverly Act); this law is also referred to as the lemon law.
Under the lemon law, consumers who purchased defective vehicles that cannot be repaired by the manufacturer could pursue claims to either get a replacement vehicle or a refund for the purchase price of the vehicle. To qualify for these remedies, the vehicle must meet the definition of a lemon by fulfilling the following three requirements:
- The vehicle must have a defect that affects value, safety, or use of the vehicle
- The vehicle must have a defect that cannot be repaired even after a reasonable number of repair attempts have been made
- The vehicle must still be under an active manufacturing warranty
If your vehicle meets these requirements, you could pursue a lemon law claim. For more information about your right to file an Ineos lemon law claim, contact us today.
What Remedies are Available?
Under the lemon law, consumers could be eligible to recover the following:
- A full refund for the purchase price of the vehicle, including government fees, and more, or
- A replacement vehicle of equal or similar value
In addition, consumers could be reimbursed for all out-of-pocket expenses for repairs, towing, diagnostics, etc. Under the lemon law, manufacturers are also required to cover all legal fees.
How Long Do I have to File a Claim?
In general, claims must be filed within four years. However, it is important to note that claims must be filed while the vehicle is still under active manufacturing warranty. The Ineos Grenadier is subject to a 5-year or 60,000-mile warranty (whichever comes first). To ensure that you have a thorough understanding of the total length of time that you have to file your claim, you should review your warranty information and reach out to an experienced lemon law lawyer as soon as possible.
